Hybrid Hearts Coaching:

General Terms and Conditions for Coaching Assignments

Preamble

Coaching is a service in the psychological field. In addition, I offer coaching based on the Christian faith at the express request of the client. In this case, I integrate both the 'Benelovent detachment' method, developed by John Eldredge and Wild at heart – as well as intercession, common prayer and discipleship coaching. Coaching itself includes strategies of self-management, the design of relationships with other people and the optimization of growth and implementation of specific concerns and decisions. Coaching is aimed at people who are mentally stable and healthy and is self-financed by them. It is not possible for health insurance companies to cover the costs incurred.

Participation in coaching workshops and seminars is also possible if:

• a mental illness is present, but is not assigned to the schizo-affective area and the participant receives comprehensive medical care (proof required/written self-declaration). I would like to explicitly point out that coaching is not a therapeutic or healing activity, cannot and does not replace therapy and adequate medical care and adjustment, and does not include any promise of healing.

Should it become apparent during the coaching process that the cause of the problems lies within the spectrum of mental illness (hidden depression, anxiety disorders, personality disorders), the coaching will be suspended/terminated until the root causes have been satisfactorily addressed by medical professionals through psychotherapy, psychiatric evaluation and, if necessary, medication by medical specialists. Continuation without compliance with these basic conditions of participation is not possible, neither legally nor personally. In this case, I will clearly communicate the suspicion, name the clues and refer to appropriate support services.

Coaching processes are learning processes, based on trust and take time.

The essential components of coaching include the willingness to question oneself, the willingness to take responsibility for self-inflicted problems and their consequences, to try out new perspectives and behavioral options, to be guided, to accept objective and subjective limits. Furthermore, it takes the will and dedication to achieve your coaching goal actively and consistently. I also expect clients to be reliable, to keep appointments and to be willing to engage in these processes of change, to welcome them and to pursue them with the aim of implementing them.

1. The coaching contract

The coaching contract is created when the client decides to take action. I offer fixed programs in the form of so-called packages and coach individually 1:1, in small groups and in group settings (workshops/ privatized Facebook groups and online zoom offers) according to the topic. The individual modules are communicated to the customer in advance, as are the duration of the respective programs and the overarching objective. Participation is subject to the conclusion of a written coaching contract. Ethical rules for dealing with each other are discussed in advance in relation to the coaching contract itself; these ethics are sent by email as part of a welcome package and are respected by both parties. In the case of online participation in social media groups, they are recognized by accepting the group rules.

2. Duty of disclosure

In order to create optimal conditions for behavioral and attitudinal changes, as well as all necessary learning processes, it is necessary that the client discloses appropriate information to his coach and answers all questions to the best of his knowledge and belief. This can also be done in writing and according to specifications. The client is responsible for any consequences arising from the client providing incomplete or untrue information.

3. service provision and place of performance

The coaching takes place by prior appointment either in person and at the coach's premises or online via Facebook group and in Zoom. The service provision corresponds to the booked package in terms of setting, number of participants and scope.

4. Duty to cooperate

The client is responsible for the fulfillment and implementation of the developed, agreed and in some cases also prescribed tasks and solutions. For all successes, omissions and “side effects” during the coaching process, the full disclosure requirement also applies. Cooperation is only possible if it is transparent, committed and responsible.

5. Confidentiality

The contracting parties shall treat as confidential, without time limitation, all knowledge of business secrets or information designated as confidential that they have acquired in the course of the contractual relationship. Written records of the coach serve his conscientious work and are indispensable.

The coach assures that he will also treat these documents confidentially. Audio and video recordings may only be made for coaching purposes by mutual agreement.

6. Remuneration

The coach receives the agreed fee for the coaching, whereby no VAT is shown due to the small business regulation. The billing is done per booked package at a flat rate and is to be paid in advance. Installment payments and reductions as well as solidarity payments are possible.

In detail:

• Jesus-Chair: I don't want to exclude anyone from seminars, coaching programs and the like because of financial hurdles. However, I can only offer free participation to a very limited extent. This is possible due to personal financial hardship, such as working in the so-called low-wage sector while at the same time being responsible for one or more children, chronic inability to work and/or (early) retirement, permanent receipt of sick pay for chronic or acute illnesses (cancer, among others). In these cases, I ask that you contact me with a reason why you want to participate, a short description of your situation and an application for the vacant Jesus chair, which each course will have from me.

• Payment by installments: In principle, I calculate my prices according to the current average coaching price segment of 60.00 euros/hour. I am aware that paying in one sum can be a real obstacle to participation. Therefore, I offer to pay the total amount in two installments for six-week offers and in three installments for eight-week offers at fixed times.

• Solidarity contribution: It is possible to make a donation to a social fund that allows me to offer discounts on services where financial difficulties exist. The available discounts depend on the amount of the solidarity contributions paid. Such amounts are to be marked accordingly when making the transfer. Thank you to everyone who makes discounts possible.

No right can be derived from the coaching contract for the client to reclaim paid fees. Coaching sessions that the client does not attend without excuse, as well as cancellations within 3 days before the agreed date, remain subject to the fee invoice. In the event of sudden illness or force majeure (such as an accident or the death of a relative) or similar circumstances, a coaching session during the term of a 1:1 support agreement can be rescheduled and made up for a maximum of 2 times in eight weeks or 1 time in six weeks. The payment obligation remains unaffected. In serious cases of force majeure, I ask that you contact me to clarify how we can proceed.

7. Liability

I as a coach guarantee that I provide my coaching to the best of my knowledge. Warranty and compensation claims by the client are excluded. Consequences arising from the client providing incomplete or untrue information are to be borne by the client. Likewise, the client bears

consequences of not fulfilling the agreed “coaching homework” and not implementing the solutions developed.

8. Force majeure and other impediments to performance on the part of the coach

In the event of force majeure, the coach is entitled to postpone the agreed coaching appointments within a reasonable period of time. This also includes obstacles to the coach's performance that arise due to illness, accident or similar. In this case, the coach will suggest an alternative appointment as soon as possible. Should life circumstances arise that result in (even temporary) occupational disability, the coaching contract will be terminated, taking into account the percentage of services provided, and any overpayments will be refunded.

9. Offsetting and refusal of performance

Any right of the client to set-off is excluded, unless the client's claim is undisputed or has been legally established.

10. Rights of use

Coaching concepts and study guides provided are protected by copyright. The rights of use lie with the coach. Duplication is not allowed. The documents are intended for the personal use of clients only. Any further use requires the approval of the coach.

Publication – even of excerpts – is prohibited and may result in prosecution.

11. Miscellaneous

Amendments and supplements to the coaching contracts must be made in writing to be effective. This also applies to agreements that

waive the written form requirement. Should individual provisions of the coaching contract be invalid in whole or in part, the contract as a whole remains

valid. The parties mutually agree to replace the invalid provision with a valid provision that most closely reflects the invalid provision in writing.

This also applies to gaps in the contract. German law shall apply to the agreements between the parties. The parties agree that the place of fulfillment and jurisdiction

shall be Göttingen/Lower Saxony.

12. Special features arising from value conflicts and business-damaging conflicts of interest:

I reserve the right to refuse clients who declare or spread extremist attitudes of any kind or who justify their actions on the basis of such an attitude. This includes, in particular, right-wing extremist positions, religiously right-wing populist fundamentalist attitudes that involve exclusion, scapegoating, witch-hunting, hostility towards foreigners and women, and positions that glorify or justify violence.

In such a case, cooperation is neither constructive nor does it correspond to the fundamental orientation of my offer and my coaching vision and ethics.
